Terms and Conditions (T&C) for MyPath

Welcome to **MyPath** ("we," "us," "our"), a software platform providing college counseling services and tools. These Terms and Conditions ("Terms") govern your use of our services, tools, and platform ("Services"). By using our Services, you agree to these Terms. If you do not agree, do not access or use the Services.

1. Acceptance of Terms
By using MyPath, you confirm that:  
- You have read, understood, and agree to these Terms and our Privacy Policy.  
- If you are under 18, your parent or guardian consents to your use of the Services.

2. Data Privacy and Security
- **We do not sell or share your data. Your personal information will be used solely as outlined in our Privacy Policy.  
- MyPath complies with Washington State privacy laws, FERPA, COPPA, and other applicable U.S. regulations to safeguard data.  
- Data stored by MyPath is encrypted and handled with strict security protocols.  
- You may request access, modification, or deletion of your data as provided under applicable privacy laws.

3. User Responsibilities
- You are responsible for:  
  - Securing your login credentials.  
  - Using the Services only for personal or professional college counseling purposes.  
- You must not:  
  - Share your account with others.  
  - Use AI features or tools to complete academic assignments, including homework, essays, or other school submissions.  
- Violations of these responsibilities will result in account suspension or termination.

4. AI Use Policy
The AI-powered features in MyPath are designed to enhance your understanding of college application processes, not to complete academic or professional tasks on your behalf.  
AI-generated responses or tools:  
  - Cannot be submitted for academic grading or plagiarism purposes.
  - Must be reviewed and edited for personalized, ethical use.  
Misuse of AI features for cheating, fraud, or misrepresentation may result in:  
  - Immediate termination of your account.  
  - Reporting of misuse to your educational institution.  

All Artificial Intelligence features provided by MyPath, including MyBot, are experimental and may produce content that is inaccurate, unverified, or inappropriate. MyPath disclaims all liability for any content generated by MyBot and advises users to review and validate all AI-generated outputs before use.

5. Subscription Terms and Refund Policy
MyPath offers one-time purchase options and recurring subscriptions.  
Refund Policy: Refunds are available only within 30 days of purchase, subject to these conditions:  
    - No content has been downloaded, saved, or otherwise accessed.  
    - The user is not enrolled in a recurring subscription plan.  
Cancellations for recurring subscriptions** apply only to future billing cycles.  
MyPath reserves the right to modify subscription terms with prior notice to users.

6. Proprietary Content and Intellectual Property 
- All tools, resources, content, and AI-generated material within MyPath are proprietary.  
- You may not copy, redistribute, or publicly share any content or feature of MyPath without express written consent.  
- Reverse engineering, tampering with, or attempting to access source code is strictly prohibited.  

 

7. Prohibited Activities 
Users must not:  
- Engage in unauthorized sharing or reproduction of proprietary tools, data, or resources.  
- Use the platform for illegal, unethical, or fraudulent activities.  
- Circumvent security protocols, including encryption or access controls.  

Violations will result in:  
- Account suspension or termination.  
- Potential legal action, including claims for damages.

8. AI Limitations and User Accountability
- AI-generated insights or recommendations are informational only and do not replace professional counseling or legal advice.  
- MyPath is not liable for any inaccuracies or errors in AI outputs.  
- Users bear full responsibility for reviewing and validating all AI-assisted content.  

 

9. Limitation of Liability
To the fullest extent permitted by law, MyPath disclaims liability for:  
- Indirect, incidental, or consequential damages arising from Service use.  
- Losses due to unauthorized account access, misuse, or failure to secure credentials.  

- Any adverse relationships/actions related with use of MyBot or any AI feature offered by MyPath.

10. Termination of Use  
MyPath may suspend or terminate accounts at its sole discretion, particularly for:  
- Violation of these Terms.  
- Misuse of AI tools for prohibited purposes.  
- Breach of proprietary content policies.

11. Updates to Terms
We reserve the right to amend these Terms at any time. Changes will take effect upon posting to our website. Continued use constitutes agreement to revised Terms.  

 

12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington. Disputes arising under these Terms will be resolved in the courts of King County, Washington.
